Terms of Use

Welcome to these Terms of Use (the “Agreement”). This Agreement is a contract between you and AquaVital (“we”, “our”, or “us”). Please read these Terms carefully before using our application (the “App” or “Software”) and related services (the “Service”). By accessing, viewing, or using the App, you agree to this Agreement. If you do not agree, please stop using the App immediately.

1. Scope of the App License

  1. We grant you a personal, revocable, non-transferable, and non-exclusive license to use the App. Unless otherwise agreed in writing, you may install, use, display, or run the App on your compatible Apple devices (including iPhone and, where available, iPad) for non-commercial purposes.

  3. You may not use the App in a manner that may damage, suspend, overload, or degrade the App (or related servers or networks), or that may impair the Service.
  4. You may not copy, sublicense, share, or sell the App or the Service to others. You are responsible for any fees arising from such unauthorized use.
  5. We reserve all rights not expressly granted. This license may terminate automatically if you violate these restrictions, and we may terminate it at our reasonable discretion.

2. AquaVital Pro Membership & In-App Purchases

AquaVital is a hydration tracking app. Certain features require AquaVital Pro (“Paid Services”), including unlimited water logging after the free allowance, Live Activity / Dynamic Island progress, optional iCloud sync, and CSV export. Exact entitlements are shown in the App at the time of purchase.

  1. Free allowance for new installs. New users may log water up to 3 times without purchasing Pro (shared across the App, Widgets, and Shortcuts). This is an in-app usage allowance, not an App Store introductory subscription trial, and it does not automatically convert into a paid subscription. After the allowance is used, further water logging and Pro features require purchase.
  2. Available purchase options. AquaVital may offer weekly, monthly, and yearly auto-renewable subscriptions, together with lifetime access as a one-time non-consumable purchase. The exact localized price displayed in the App and at App Store checkout at the time of purchase prevails.
  3. Payment. Payment is charged to your Apple ID account at confirmation of purchase through Apple’s In-App Purchase system. For auto-renewable subscriptions, your account will be charged within 24 hours prior to the end of the current period, and the subscription will renew for another period of the same length unless canceled.
  4. Managing or canceling subscriptions. Auto-renewable subscriptions are managed by Apple. To cancel, open iOS Settings ▸ [your name] ▸ Subscriptions, select AquaVital Pro, and cancel. If you do not cancel at least 24 hours before the end of the current period, the subscription will renew. Deleting the App does not cancel a subscription.
  5. Lifetime purchase. Lifetime access is a one-time purchase and does not auto-renew. It is not a subscription.
  6. Restore. You may restore eligible prior purchases via the Restore control in the App’s subscription screen.

3. Privacy and Personal Information

  1. We respect your privacy and handle personal information in accordance with applicable law. Please read our Privacy Policy, which explains what information we collect and how we use it.
  2. Depending on the features you enable, the App may request permissions such as: AquaVital does not require camera or photo library access for core hydration tracking.

4. Intellectual Property Rights

  1. You acknowledge that we own or lawfully control the rights in the App, including intellectual property in the Software and Service.
  2. Content in the App (including text, software, graphics, icons, and related materials) is protected by copyright, trademark, and other laws. You may use such content only as authorized for personal use of the App. Unauthorized reproduction, modification, or creation of derivative works is not permitted.
  3. Except as expressly agreed in writing, this Agreement does not grant you rights to use our name, trademarks, logos, or other brand features.

5. Your Data and Content

  1. AquaVital primarily stores hydration logs, goals, and related preferences on your device (and, if you enable Pro iCloud sync, in your iCloud Key-Value storage associated with your Apple ID). The App is not a social network and does not operate a public content feed.
  2. You retain ownership of the hydration records and other materials you create in the App (“Your Content”). You are responsible for Your Content and for ensuring you have the rights needed to store or export it.
  3. If you choose to export data (for example via CSV where available), you are responsible for how you store or share that file.
  4. You agree not to use the App to store or transmit unlawful, harmful, infringing, or abusive material, or to attempt to disrupt the Service.

6. Paid Services

  1. Some features require payment as described in Section 2. After successful payment, you receive the corresponding Paid Services for the applicable subscription period or, for Lifetime, on a one-time basis subject to this Agreement and Apple’s terms.
  2. Payments are processed by Apple. You agree to Apple’s applicable terms for In-App Purchases and subscription management.
  3. We may change pricing or which features are free or paid in the future. Changes will not affect the current prepaid period of an active subscription already purchased through Apple, except as allowed by Apple’s rules and applicable law.
  4. Except where required by applicable law or Apple’s refund policies, purchases are generally non-refundable once completed. Refund requests for App Store purchases should be submitted to Apple.

7. Health Disclaimer

AquaVital provides hydration tracking and general wellness tools. Daily goals and suggestions are estimates for personal convenience and are not medical advice. The App is not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare professional for medical questions, especially if you have a health condition that affects fluid intake.

8. Indemnification

You agree to hold us harmless from claims, including claims for damages, that other users or third parties (including public agencies) assert against us because of your violation of this Agreement or our Privacy Policy, to the extent permitted by law. You shall bear reasonable costs (including reasonable legal defense costs) arising from such violation. Our other rights remain unaffected.

9. Limitation of Liability and Disclaimer

  1. You acknowledge that the App and Service may be interrupted or unavailable due to force majeure, device or network issues, system instability, or other technical reasons. To the maximum extent permitted by law, we are not liable for such risks.
  2. To the maximum extent permitted by law, we are not liable for losses arising from telecommunication failures, device failures, internet issues, or force majeure.
  3. We may amend, suspend, or discontinue features of the Service as reasonably needed for business or technical reasons, subject to applicable law and App Store rules.
  4. Software not officially released or authorized by us may be unsafe. We are not responsible for losses arising from unauthorized copies or modified versions.
  5. THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Use by Minors

The App is not directed at children. If you are a minor under the laws of your jurisdiction, you should obtain consent from a parent or guardian and use the App under their guidance. Guardians should help minors understand this Agreement before use.

11. Modifications

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the App after an update constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent.

12. Update, Suspension, and Termination

  1. You may stop using the App at any time.
  2. The App may update over time. If you do not install updates, some features may become unavailable; you are responsible for any resulting limitations.
  3. We may amend, interrupt, suspend, or terminate access to the App or Service where reasonably necessary (including for security, legal compliance, or abuse prevention).
  4. We may suspend or terminate Service related to your use if you breach these Terms, if required by law or competent authorities, or if other legitimate grounds exist.
  5. Upon termination, and subject to applicable law, we may delete App-related information under our control. Local data on your device remains under your control unless you delete the App or clear data yourself.

13. Other Terms

  1. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  2. You may not assign rights or obligations under these Terms without our prior written consent.
  3. If any provision is held unenforceable, the remaining provisions continue in effect.
  4. For purchases made through the App Store, Apple’s terms (including Apple’s Licensed Application End User License Agreement and subscription terms) also apply. In case of conflict regarding payment, renewal, or refunds handled by Apple, Apple’s terms control those topics.
